BOMBONIEREcreations.com.au Web Site is owned by Bomboniere Creations. By accessing, browsing or purchasing/ordering from this Web Site, you expressly agree to be bound by the following terms and conditions:-
GENERAL
In these terms and conditions, BC means Bomboniere Creations (ABN 33 121 963 002) or its authorised representatives.
These terms and conditions form a legally binding agreement between you and BC (“BC” or “we” or “us”) governing your use of this Web Site.
A reference to this “Web Site” means the web site at http://www.BONBONIEREcreations.com.au.
BC reserves the right to make any changes to the terms and conditions at any time, without any prior notice and at BC’s discretion.
Information provided to us by you, must be current, correct and complete and by providing this information you are warranting that all the information is true and correct and that you agree to indemnify BC for any losses, expenses and/or damages that BC may suffer if any of the information provided by you is incorrect or incomplete.
Only persons over the age of 18 years and any other persons who are not legally prohibited from entering binding contracts may enter into a legally binding agreement with BC.
ORDERING & PAYMENT OF GOODS
Any order made by you on the Web Site remains an offer by you to purchase a product for the price (plus delivery and other applicable charges) as advertised on the Web Site at the time you place your order. BC reserves the right to accept or reject your offer for any reason including the unavailability of the specified good/s or error of description or price quoted on the Web Site.
BC reserves the right to modify, suspend or terminate any orders using BC’s discretion. BC will not be liable for the suspension, termination or modification on any orders cancelled by BC and BC will not be liable for any losses incurred by you as a result.
A minimum of 30% deposit of the total cost is required when placing an order before we can process your order.
Alterations, only to colour and quantity, on orders must be made within 14 days after the original order date.
Handmade goods viewed on the Web Site may be subject to slight variations and you cannot make any claims for any refunds and you agree to indemnify BC for any losses, expenses and/or damages that BC may suffer as a result.
All products ordered by you will remain the property of BC until final/ full payment is received. Goods will not be dispatched without full payment.
All prices are quoted in Australian dollars.
PAYMENT & DELIVERY OF ORDERED GOODS
Payments can be made by direct deposit, money order (made out to BC), and credit card.
Delivery will be organised by BC and you will be charged a delivery fee (No delivery fee will be charged if you arrange to pick up your order).
BC will endeavour to pack goods so that they are secure when delivered, however BC but will not be liable for goods damaged during delivery by BC’s appointed carriers.
BC will endeavour to deliver items to you, by or on your specified date, subject to full payment being received.
If you receive any faulty items you must notify BC within 3 business days of receipt.
REFUND POLICY
BC, at its own discretion, reserves its right to provide a refund of money to be paid only in the following circumstances:
• Goods (excluding handmade goods) that are substantially different to the sample shown on the Web Site.
• Goods that do not fit their description.
• Goods ordered that are out of stock.
You will not be entitled to a refund if:
• You simply change your mind about the product/order.
• Goods are damaged once they have left our premises as all risk to the products pass to you on dispatchment from BC.
TERMINATION/ CANCELLATION FEES
Termination/ cancellation of any order by you during and after production is complete will entitle BC to retain the 30% deposit paid by you at the time of the order and may not be used as credit by you for the purchaser/ order of any other goods.
If you have requested your order be picked up by you, goods must be picked up within 30 days of the date arranged, after which time the goods will be considered cancelled and BC is entitled to retain the 30% deposit paid by you at the time of the order and may not be used as credit by you for the purchaser/ order of any other goods.
